If PASSED, this Initiative will enshrine abortion into our state constitution and adversely affect and/or eliminate critical health and safety standards:

Wide Scope

No guardrails at all for abortion, including partial birth abortion; precludes the State from being able to enforce valid health and safety regulations as it prohibits the State from taking an “adverse action” based on pregnancy outcomes. By not defining “adverse action,” this sentence injects significant uncertainty into many aspects of standard medical care.

Eliminates “Informed Consent” Standards

Shields Medical Providers from malpractice as it immunizes a particular class of medical providers from any penalty, prosecution, or adverse action, so long as the provider obtains voluntary consent. This seemingly precludes ordinary functions of the State’s medical licensing boards. MCA § 37-3-323. It also raises questions whether state courts could continue to be a venue for medical malpractice lawsuits for issues other than the existence of consent (medical malpractice cases involve a violation of a standard of care and informed consent might be part of that standard of care).

Remove Parents

Parents will not be a part of their minor child’s decision to abort

Pro-Life Laws

Bills to protect life will be struck down as “unconstitutional”

Increase Sex Trafficking

Will make Montana a safe haven for violent offenders and sex traffickers.

Hide More Predators

Will allow Planned Parenthood to hide cases of statutory rape.
